Can you explain your arational for saying "You might be surprised to learn that other terms that might not be necessary in your SaaS subscription agreement are traditional software license terms."

A customer may not be receiving software or installing it on their system, but they are getting the right to access and use the software.

How are traditional license terms not required? (such as a license grant)

Bruce,

Thank you for a great article on SaaS agreements. I work with technology companies in the healthcare space who are primarily delivering solutions in a single-tenant or multi-tenant SaaS/ASP environment. The healthcare part provides even more complexity dealing with healthcare data privacy and security requirements.

Appreciate your writing as it has great reminders about what to think about.

Very interesting article. I'd be interested in an article on setting up a channel to resell SaaS, there are probably some interesting legal twists on this as well.
